Agreement to terms

These Terms of Service (“Terms”) govern your access to and use of the FundPath website, assessment, reports, accounts, and related services (collectively, the “Services”), operated by Nurturely+ (nurturely.io). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Description of services

FundPath is an independent financing-readiness tool. We help business owners understand which financing products may fit their stated situation based on the information they provide. FundPath is not a lender, broker, bank, or financial advisor. We do not make credit decisions, issue loans, or guarantee that any lender will approve or fund your request.

Preliminary results only

Any report, match, or recommendation generated by FundPath is preliminary and informational only. It is not an approval, preapproval, commitment to lend, or guarantee of any funding amount, rate, or term. Actual product availability, rates, terms, and approvals are determined solely by lenders, funding providers, and other third parties after their own review of a completed application and supporting documentation. All illustrative rates, amounts, structures, and timelines are subject to change and lender underwriting.

Eligibility and authorized representation

You must be at least 18 years old and authorized to act on behalf of the business you represent. Do not submit information about a business unless you are authorized to do so. You agree that all information you provide is accurate, complete, and not misleading.

Account creation and security

When you provide your name, email, and phone number to receive a report, we may create an account for you automatically so you can access your results, save scenarios, and compare options. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

Accuracy of information

You are solely responsible for the accuracy of the information you submit through the Services. Inaccurate, incomplete, or outdated information may produce inaccurate results and may affect any financing request you pursue with a third-party lender.

Intellectual property

All content, materials, software, and intellectual property included in or made available through the Services are owned by Nurturely+, FundPath, or our licensors and are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, lease, or reverse-engineer any part of the Services without our prior written consent.

Prohibited uses

You agree not to use the Services to: violate any law or regulation; infringe the rights of others; submit false, fraudulent, or unauthorized information; attempt to access data belonging to others; interfere with the operation of the Services; introduce malware or harmful code; or engage in any activity that could damage, disable, or overburden our systems.

Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, all licenses and other rights granted to you under these Terms will immediately cease.

Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NURTURELY+, FUNDPATH, AND THEIR OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE CLAIM OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Indemnification

You agree to indemnify, defend, and hold harmless Nurturely+, FundPath, and their officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any third-party right.

Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Delaware. You consent to the personal jurisdiction of those courts.

Changes to terms

We may modify these Terms from time to time. The updated Terms will be posted on this page with a revised effective date. Your continued use of the Services after the changes take effect means you accept the revised Terms.

Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and share your information.
